Effective 17 August 2026, digital platform workers delivering food, beverages, and groceries across Australia are entitled to comprehensive new minimum labor standards under landmark workplace reforms enacted by the Commonwealth.
Under the ruling handed down by the Fair Work Commission (FWC), delivery riders and drivers will receive a baseline statutory rate starting at approximately AUD 31.30 to 32.00 per hour, calibrated according to vehicle type. Crucially, the minimum pay calculation encompasses waiting intervals at restaurants and merchant depots, rather than solely active delivery transit time.
This structural shift provides greater revenue predictability for participants in Australia’s expanding gig economy.
Mandatory personal injury insurance and dispute resolution
Alongside hourly remuneration floors, digital platforms must fund comprehensive personal accident insurance for eligible gig couriers. Delivery workers remain responsible for maintaining compulsory third-party vehicle insurance when utilizing cars, vans, or motorbikes.
The framework also formalizes transparent dispute resolution mechanisms and provisions for unpaid leave under specified circumstances.
Scheduled minimum rate increases in 2027
Following the August 2026 rollout, minimum platform rates are scheduled to increase by an additional AUD 0.50 per hour from 1 January 2027, progressively establishing an equitable safety net for gig economy workers nationwide.
