Can Small Businesses in Australia Sponsor Employees Under Subclass 482 Visa?

A prevalent misconception among business owners in Australia is that sponsoring skilled foreign employees under the Skills in Demand Visa (Subclass 482) requires a large corporate enterprise with substantial headcount or high annual turnover. In reality, Australian migration legislation does not impose arbitrary staff size thresholds.

Small and medium enterprises (SMEs) can successfully qualify as Standard Business Sponsors (SBS) and nominate skilled personnel, provided they demonstrate lawful commercial operations and establish that the nominated position is genuine and operationally justified.

1. Can small enterprises qualify as Standard Business Sponsors?

Under Department of Home Affairs (DHA) guidelines, an enterprise must be lawfully established and actively trading in Australia. There is no statutory rule stating a business must employ a minimum number of workers to sponsor staff. Once approved, Standard Business Sponsorship remains valid for 5 years.

2. Proving a Genuine Position

For small businesses, case officers carefully evaluate whether the nominated role is a Genuine Position aligned with daily commercial activities, rather than an artificial position created primarily to facilitate migration.

3. Remuneration requirements: CSIT and Annual Market Salary Rate

Sponsoring employers must satisfy two statutory remuneration standards:

  • The guaranteed annual salary must equal or exceed the Core Skills Income Threshold (CSIT: AUD 79,423/year from 1 July 2026).
  • The package must meet the Annual Market Salary Rate (AMSR) equivalent to what an Australian citizen or PR would earn in that regional market.

4. Labour Market Testing (LMT) and Skilling Australians Fund (SAF)

Employers must advertise the position across at least two approved national platforms for 4 consecutive weeks, and contribute the mandatory SAF Levy based on annual turnover.
